Delivery and Installation

Delivery is made by truck or freight forwarder to the address specified by the customer, for example to the residence or the construction site. Transport costs are shown separately in the order confirmation. Delivery includes unloading (e.g., curbside / parking area), but does not include carrying the goods into the property.

If assembly or installation has been agreed, one single trip to the site is included in the transport price. Additional trips will be charged separately. The disposal of pallets or packaging materials is the customer’s responsibility and is at the customer’s own expense.

Any delivery dates provided by Sky Pergola are non-binding. Sky Pergola endeavours to meet the agreed dates, but cannot guarantee them. Claims for damages or withdrawal from the contract due to delivery delays are excluded.

Sky Pergola is entitled to make partial deliveries, provided this is reasonable for the customer. A delivery date can only be met if the customer complies with their duties to cooperate and provides all information required for delivery and, where applicable, assembly in good time.

If the customer is in default of acceptance or breaches their duties to cooperate, Sky Pergola is entitled to claim compensation for any resulting damage.

If installation requires special organisational or structural measures (e.g., crane, special transport or structural adaptations), Sky Pergola must be informed of this when the contract is concluded. Sky Pergola is entitled to carry out such measures itself or have them carried out by third parties. The customer bears the costs incurred.

The customer is responsible for ensuring that the structural conditions for proper installation are in place. This includes, in particular, a suitable substrate as well as the required electricity and water connections in accordance with the technical requirements.

Responsibility for any permits that may be required (e.g., from authorities, the landlord or neighbours) lies entirely with the customer. The absence of the relevant permits has no effect on the validity of the contract and does not give rise to any liability on the part of Sky Pergola.
